1. Agreement and eligibility
These Terms form an agreement between you and My Cloud World, operator of Notify Digitally. By creating an account or using the service, you accept these Terms. You must be legally able to enter this agreement and authorized to act for the business whose messaging accounts you connect.
2. The service
Notify Digitally provides software for connecting supported providers, sending notifications, managing approved WhatsApp templates, using API keys, and reviewing delivery history. WhatsApp permits business-initiated messages only through templates approved by Meta, except where Meta's conversation rules permit other content. Telegram and email may support custom content subject to provider rules.
Features may change, and provider availability depends on third-party platforms outside our control.
3. Accounts and credentials
You must provide accurate information, protect passwords and API keys, use individual authorized accounts, and notify us promptly of suspected unauthorized access. You are responsible for activity performed through your account and for safely configuring connected provider accounts.
4. Messaging responsibilities
You are solely responsible for your recipients, content, timing, campaigns, and instructions to Notify Digitally. You must:
- Obtain all legally required consent and honor opt-outs promptly.
- Use accurate sender and business identity information.
- Follow applicable marketing, privacy, consumer protection, telecommunications, and anti-spam laws.
- Follow Meta, WhatsApp, Telegram, ToSend, and other applicable provider terms and policies.
- Use WhatsApp templates only for their approved purpose and without misleading substitutions.
5. Prohibited use
You may not use the service for unsolicited bulk messaging, unlawful or deceptive content, harassment, malware, credential theft, discrimination, regulated goods where prohibited, infringement, attempts to bypass provider limits, unauthorized access, or interference with the service. You may not upload recipient data you are not authorized to use.
6. Charges and credits
Applicable subscription charges, platform credits, provider charges, taxes, and payment terms will be disclosed with the relevant plan or order. Provider charges may be billed directly by the provider. Credits may expire or be non-refundable where disclosed at purchase, except where applicable law requires otherwise.
7. Third-party services
Meta, WhatsApp, Telegram, ToSend, hosting providers, and other integrations are independent services governed by their own terms. We do not control their approval decisions, pricing, delivery, outages, account restrictions, template decisions, or policy changes. Your right to use an integration depends on maintaining authorization with that provider.
8. Suspension and termination
You may stop using the service and request account deletion. We may restrict or suspend access when reasonably necessary to address security risks, non-payment, unlawful conduct, provider-policy violations, harm to recipients, or material breach of these Terms. Where practical, we will provide notice and an opportunity to remedy the issue.
9. Disclaimers and liability
The service is provided on an “as available” basis to the extent permitted by law. We do not guarantee uninterrupted operation, provider approval, message delivery, or particular business results. To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms excludes liability that cannot legally be excluded.
10. Contact and changes
We may update these Terms and will publish the revised version with a new effective date. Material changes may also be communicated through the service or email. Questions may be sent to contact@mycloudworld.com.
